Seller: Artparadize
Buyer: An individual/organization who agrees to buy artwork from Artparadize.
Terms and Conditions of Sale
- All invoices will be raised by Artparadize based on the registration information provided by the Buyer or amended at the time of finalizing a purchase. Payments will be accepted only from the registered Buyer. In the event that a payment is sent by a person other than the registered Buyer, it may either be returned or could result in a delay in processing the order until the Seller decides whether a variation from the registration details may be accepted.
- Payments once made to Artparadize are non-refundable.
- In case of an overseas sale, payments will be accepted only in US$ in order to avoid discrepancies in exchange rate.
- Applicable Taxes (GST) should also be borne by the Buyer at the rate prevailing at the time of raising the invoice. This will be added in the Invoice.
- In case the artwork delivery address is in the same city/country of the Seller’s address, the delivery will be done free of cost. In case the delivery address is in another country, the freight charges needs to be borne by the Buyer over and above the actual price of the artwork. The buyer will be intimated of the freight charges before the purchase of the artwork.
- Custom Duty/ Vat, etc, if applicable and/or levied during clearance in case of an overseas buyer will have to be bourne by the Buyer.
- Sales Tax Authorities of a few States in India require certain Sale Tax Forms to allow entry of artworks into their State. It will be the responsibility of the Buyer to obtain such Sale Tax Forms, if required, and provide the same to the Seller, to enable the Seller to dispatch the artwork.
- All supporting documents related to the artwork/s shall be delivered only with the artwork.
- Local delivery will be made with in a week and the maximum timeline for delivery within the country is two weeks. International delivery will have an outer limit of one month. If the delivery is not made due to any reason within the given time frame, either the payment made will be reimbursed or we can proceed for delivery based on the mutual agreement between Artparadize and the buyer. The delay may happen due to some unavoidable circumstances like artist out of station or unwell or transport strike, etc.
- Due to some technical reason/issue if the artwork bought by the customer (buyer) cannot be delivered, the buyer would be informed on her/ his given contact details and the money would be refunded interest free within a month
- Purchase Terms: Mode of payment:– By bank transfer/demand draft/account payee cheque/debit or credit cards/RTGS/NEFT. Delivery of artwork:– The artwork will be delivered only after the Seller receives the clear fund in its bank account.
- The buyer agrees to abide by all provisions prescribed in these terms and conditions and warrants that all information submitted is true and accurate (including without limitation the credit card number and expiration date), and agrees to pay all costs, charges and all applicable taxes for the purchases made.
- All copyright in material relating to the Work vesting with the Seller shall remain with the Seller. Seller reserves the right to exploit all such copyright.
- Antiquities and Art Treasures are not allowed to be exported out of India as per The Antiquities & Art Treasures Act, 1972. An undertaking to this effect is required to be given by the Buyer to the Seller if an Antiquity/National Art Treasure is purchased.
- Though there is a screening process by the seller, self declaration by the artist would be considered final regarding the authenticity and description of the artwork.
- Only original artwork of the artist is hosted in the website. However, it could be inspired by some other artwork. The uniqueness of the artwork is not guaranteed. Hence, all artwork based on its description and uniqueness is accordingly priced.
- Each artist is asked to honour the ‘copy right policy’ through a written MOU, i.e. no artwork should be a copy of artwork by any other artist or prior permission to copy needs to be obtained in case of similarity. However, the work could be inspired by some other artwork.
- In case of any such dispute arising due to copy of artwork or wrong disclosure of the description of artwork or wrong disclosure of artist name, or any such related issue, the gallery is not responsible, as thousands of artwork are being hosted from across the globe. The authenticity and originality of the artwork is the sole responsibility of the artist.
- In case of any issue related to violation of ‘copy right policy’, the same needs to be brought to the notice of Artparadize immediately at support@artparadize.com and appropriate action to remove the disputed artwork will be taken within 7 - 10 working days.
- Once a sale happens, the artwork will be accompanied by an ‘authentication certificate’ signed by the artist declaring the authenticity of her/his artwork.
- In case question arise on the authenticity of the artwork, the artist is solely responsible to respond. Seller in no way is responsible and is also not entitled to provide any compensation.
- All artworks, on the website, are supported by an authenticity certificate duly signed by the artist.
- In case of damage to the artwork due to faulty/damaged packaging, the same would be taken up on a case to case basis. Either the money is refunded or an alternate delivery is arranged based on mutual agreement between buyer/ artist and seller. However, damaged frame cannot be compensated.
- Seller does not entertain return and cancellation under any circumstance if the selected painting has reached the buyer without any issue.
- There could be a slight change in visual appeal between the original painting and its picture in the website because of factors like camera quality, lighting, etc.
